You and WiseIQ agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the service ("Dispute") will be resolved by binding individual arbitration, not in a court of law. By agreeing to these Terms, you and WiseIQ each waive the right to a trial by jury and the right to participate in a class action lawsuit or class-wide arbitration.
Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in the state of your residence or, at your election, by videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You and WiseIQ agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. To the extent that any dispute is not subject to arbitration under Section 13, you consent to the exclusive jurisdiction of the state and federal courts located in Wyoming.
